A lien is a right to keep possession of a property belonging to another person until a debt owned by that person is discharged.

A lien can be problematic because it indicates that someone else has a legal claim on your property due to unpaid debts or obligations. It essentially means that the property is encumbered, which can create several issues:

  • Difficulty Selling or Refinancing: When there’s a lien on your property, it can make it difficult, if not impossible, to sell or refinance until the lien is resolved. Potential buyers or lenders will be hesitant to proceed with the transaction unless the lien is cleared.
  • Legal Consequences: If the lien is not paid off or resolved, the lienholder may have the legal right to take further action, including seeking a court judgment or potentially foreclosing on the property.
  • Damage to Credit: If the lien is the result of unpaid debts, such as property taxes, loans, or contractor work, it can negatively affect your credit score, making it harder to secure future loans or lines of credit.
  • Additional Costs: There may be legal fees, interest, and penalties associated with resolving the lien, adding to the overall cost of addressing the issue.
  • Reduced Property Value: Even if the lien doesn't lead to foreclosure or a forced sale, it can still reduce the perceived value of your property, as buyers may be wary of purchasing a home with outstanding financial claims attached.
